NO PURCHASE NECESSARY IN NJ, MD & VT
- Contest Period: The TYR Hurricane Freak of Nature, Ironman New York 2012 Contest (the “Contest”) begins on November 15, 2011 and ends on May 31, 2012 (“Contest Period”).
- How to Enter: There will be two Judging Periods during the Contest Period- Judging Period 1 runs from November 15, 2011 through January 31, 2012 and Judging Period 2 runs from February 1, 2012 through May 31, 2012. During the Contest Period, consumers who have purchased the TYR Hurricane Freak of Nature Triathlon wetsuit (“wetsuit”) may access the Contest by visiting the Website at www.tyr.com/limitswillfall (“Site”). Entrants must register their personal information, along with the serial number of the wetsuit and the access number found in the packaging included with the wetsuit and will then be served up a photo. Entrants, in 100 characters or less, must write a humorous caption for the photo that reflects the spirit of the TYR Brand, in order to complete the Entry (“Entry”). For residents in the states of New Jersey, Maryland and Vermont, a purchase is not required and you may include the following numbers during registration to participate: New Jersey residents: a) serial number NJ0002 and b) access number NJ5182; Maryland residents: a) serial number MD0001 and b) access number MD5842; and Vermont residents: a) serial number VT0000 and b) access number VT5622. Any residents of states other than NJ, MD and VT that attempt to enter with the above numbers will be automatically disqualified. All Eligible Entries need to be received by January 31, 2012 to be eligible for Judging Period 1. All Eligible Entries must be received between February 1, 2012 and May 31, 2012 to be eligible for Judging Period 2. Entries from Judging Period 1 will be carried forward into Judging Period 2. Limit one entry per consumer.
Your Entry must: (1) be completely original; (2) be solely created by you; (3) be in English; and (4) not infringe the rights of any third party, including but not limited to copyrights, patents, trademarks, trade secrets, and rights of publicity/privacy. Any Entry, or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, language that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may be disqualified. Entrants may not copy or otherwise plagiarize the Entry Materials from any source. No information regarding Entries or judging, other than as otherwise set forth in these Official Rules, will be disclosed.
- Eligibility: Contest is open to legal residents of the U.S. and Canada (excluding Quebec), who are 18 years of age or older at the time of entry and have purchased the TYR Hurricane Freak of Nature Triathlon wetsuit & must have completed an Ironman 70.3 race. Residents in the states of NJ, VT & MD are not required to make a purchase to enter the Contest. Employees of TYR Sport, Inc (the “Sponsor”), Ironman, World Triathlon Corporation, Swimwear Anywhere, their officers, directors, members, shareholders and advertising and promotional agencies, including Don Jagoda Associates, Inc., and their respective affiliates and subsidiaries, and the immediate family members and people living in the same household of each are not eligible. Void in Quebec and where prohibited or restricted by law.
- Grand Prizes and Approximate Retail Values (“ARV”): Grand Prizes (2 total- 1 prize awarded during Judging Period 1 and 1 prize awarded during Judging Period 2): A 6-day/5-night trip to NYC, New York for two (2) and Entry into the 2012 Ironman U.S. Championship in NY/NJ on August 11, 2012 (“championship”) for winner only. Trip includes round trip coach air transportation from major airport nearest winner’s residence to NYC, NY; round trip ground transportation to/from airport/hotel, and five (5) nights Sponsor-selected hotel accommodations (double occupancy) (ARV: $6,100 each). Grand Prize trips must be taken on dates specified by Sponsor surrounding the championship; dates of departure and return are subject to change. Winners agree that Sponsor may videotape and/or photograph any interviews, as well as portions of the trip, including before, during and after championship (”footage”) and Sponsor and its agencies may use this footage in any way they see fit. Actual value of Grand Prize will depend on point of departure, dates of travel and any airfare fluctuations. Any difference in value will not be awarded. Airline carrier and agent to be selected by Administrator at its sole discretion. Grand Prize winners and respective guest must travel together on the same itinerary and air transportation and hotel accommodations must be taken by Grand Prize winners and guests together. Air transportation included will be for domestic travel between the United States and Canada only. Once trip dates have been booked, no extension or substitution of trip dates is permitted, except at Sponsor’s sole discretion. Once travel has been confirmed, any cancellation or change fees or restructuring of the trip are the sole responsibility of the Grand Prize winners. Airline carrier's regulations and conditions apply. If a Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must accompany Grand Prize winner on trip as the guest. Guests must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless accompanied by his/her parent/legal guardian (who must be a Grand Prize winner). Grand Prize winners’ guests will be required to execute a Release of Liability and Publicity Release prior to travel. Grand Prize winners and guests are solely responsible for providing all necessary identification documents and will be responsible for obtaining all necessary travel documents (i.e., valid government-issued photo ID, etc.). Failure to provide such documents may result in trip cancellation upon airport check-in. Grand Prize winners and/or his/her guests must have/present at least one major credit card in good standing in order to check into hotel. The Grand Prize trip restrictions/conditions stated herein are not all-inclusive and may be subject to additional restrictions/conditions, which may be stated in the affidavit (described below) and/or winner's travel documents. Sponsor is not responsible for lost or stolen tickets/passes/itinerary/identification, etc. The following is the sole responsibility of the Grand Prize winners and his/her guests: travel insurance; room service; laundry service; spa treatments; alcoholic beverages, unspecified meals; local and long distance telephone calls; merchandise and souvenirs; incidental expenses; additional tips and gratuities; and all other costs and expenses not otherwise mentioned herein. All other expenses and incidentals not specifically mentioned as being included are excluded and are the Grand Prize winner’s sole responsibility. If a Grand Prize winner lives within 150 miles of NYC, NY, the Sponsor reserves the right to substitute ground transportation for air transportation, in their sole discretion and no additional compensation will be provided. Grand Prizes are non-commissionable and no substitutions, transfers, or cash equivalents for the Grand Prizes (or prize component) are permitted, except that Sponsor may substitute prize component of equal value for any reason. In the event the championship is cancelled for reasons out of Sponsor’s control, the Entry ticket portion of the prize will not be awarded and no additional compensation will be provided. Sponsor reserves the right to substitute prize of equal or greater value. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Accommodations are subject to availability. Seat selection and timing of trip subject to availability and confirmation of reservations.
- Judging: All Eligible Entries received during each Judging Period will be judged by a panel of judges determined by Sponsor to determine the two (2) Grand Prize winners (broken out as described in Rule #4). Each Entry will be judged based on the following criteria: Originality: 1/3; Humor: 1/3; and Spirit of the Triathlon: 1/3. In the event of a tie, tied entries will be rejudged by the judges based solely on: Spirit of the Triathlon. Decisions of the judges are final with respect to all matters relating to this Contest. Winners will be notified by phone, mail and/or e-mail.
- General Rules: Decisions of the Sponsor are final with respect to all matters relating to this Contest. By participating, entrants agree to the Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. Potential Grand Prize winners will be required to complete an Affidavit of Eligibility/, Liability/publicity release (where legal) and Assignment of Rights, or if winner is a Canadian resident, a Declaration of Compliance, within ten (10) days of notification attempt or the prize may be forfeited and an alternate winner may be determined. Return of prize notification as undeliverable may result in disqualification and alternate determination. The Sponsor and its agents are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Contest, or by any human error which may occur in the processing of the Entries in this Contest, or for any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Contest. The Sponsor reserves the right in its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest, the Contest Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest process, then the Sponsor reserves the right at its sole discretion to cancel the Contest and determine the winners via Judges based on judging criteria listed above, from among all eligible approved screened Entries received prior to cancellation.
- Release: By entering the Contest and/or winning a prize, you hereby grant the Sponsor and World Triathlon Corporation (the “Releasees”) and its agencies, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, reproduce, re-arrange, change, add to or delete from, translate, adapt or otherwise revise and/or alter the Entry and Footage (as applicable), or any display thereof, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the caption, for editorial, commercial, promotional and all other purposes. In addition, you hereby assign to the Releasees all royalty-free, non-exclusive rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the caption/footage. You represent and warrant that: (i) you have the right to grant any and all necessary rights and licenses provided herein, including without limitation, all necessary copyright and other related rights to the artwork, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity, (ii) you hereby hold the Releasees harmless from and against any third party claim arising from use of the Entry/footage and you waive any right to inspect or approve uses of the Entry/footage or to be compensated for any such uses. Participating in the Contest constitutes permission to the Releasees to use participants’ names, biographical information, pictures/portraits, likenesses, Entry, footage and/or voices, for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in the Contest, the Entrant agree that Releasees and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents, will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of the prize, if applicable or participation in the Contest or participation in any contest or prize related activity.
